A Toronto landlord says she's been conned by a "professional tenant" who's been living in her Yorkville home since July without paying rent.
"It's been a living hell for the past two months," Robin Ennis said in an interview with CBC News.
The matter is the subject of a case being heard by the Ontario Landlord and Tenant Board.
The tenant, James Regan, 62, lost a similar dispute at the board earlier this year over another property he was occupying. The board ordered his eviction in that case.
Regan appealed that eviction and lost in Ontario Superior Court, a process that took eight months, during which he lived rent-free in the condo near Old Mill Road and Bloor Street West.
Rent was $3,200 per month and, according to court documents, Regan owed more than $25,000 when a second eviction was ordered on July 29. He never paid any of that money, court documents show.
The following day, Ennis said she met Regan, who was well-dressed and polite, when he inquired about renting a second-floor apartment in her home on Avenue Road near Dupont Street.

Ennis says they signed an agreement to lease and Regan promised to pay first and last month's rent, provide proof of insurance, as well as a credit and criminal background check.
But the following day, Friday July 1, Ennis says Regan showed up at the home unannounced claiming to have valuable art he urgently needed to store.
Ennis gave Regan the keys to the unit, which she says he did not return.
By July 2, Ennis says Regan had moved himself and other belongings into the home. When she confronted him about paying first and last month's rent, Ennis says Regan was confrontational.
"He stole the keys and said I'll see you at the Landlord and Tenant [Board]," Ennis said.
Hearing pushed backThe matter was first heard by the board on Sept. 8, but only one of Ennis's two complaints could be dealt with, because Regan claimed he didn't receive the right paperwork in the mail.
The matter has been pushed back until late November.

Read the article yesterday and to be honest it's a lot more common then one might think. I'm a fairly new landlord myself and knowing that there's people like this out there I took a lot of precautions when choosing a tenant. It's unfortunate things like this happen but as a landlord we clearly are the ones who have a lot to lose. Landlord tenant laws are not in our favour. Due diligence on our parts is key, no matter how innocent (or in my case good looking!) the potential tenant may be, it's necessary to approach all applicants equally.

Went through similar & when I served papers to him he called the cops after I left with some bogus story . More than 10k later he left and moved around the block . Scum !

In my travels I encountered a real estate agent in failing health tell me how he ended up buying properties that started out as rentals . He would rent a home with the option to extend his lease (1 or 2yr) and when the landlord would try to sell the property he said he would exercise his right and that his right even trumped the banks in a foreclosure so he would buy the house out at a bargain from the bank or the landlord who was desperate to sell for whatever financial reasons . The house I met him at was a rental... wonder what he's gonna put his landlord through on this one ? Found it odd that he showed me pics of the houses he bought and explained the circumstances to me .

We've created a whacked out system in Ontario that allows this - it's too common and the system is easy to manipulate. If a tenant has a contract issue they should have to continue to pay the rent until the issue has been decisioned by the Landlord/Tenant Board instead of the situation that has been created where they can withhold for long periods while they draw the process out through the system.

This is why the only Landlord to be, is a Commercial Landlord, none of Pro-Tenant BS in a Commercial Lease.
A lot of these squatters, will trash the place the day before they are evicted too!

The Landlord and Tenant Act is an important component of the Left Wing Wealth Transfer Manifesto, so any changes are likely to continue to favour the Tenant.

OOOOHHH. I've been through this and it cost me my retirement.
In 2002 I bought a 12 unit apartment in Kitchener. (ist mistake: too far away to manage effectively). I owned it for 7 years.
#1 problem tennant. We had a guy that I inherited from the previous landlord. He was a petty theif, but worse, a hoarder. On top of that, he was a ward of the Ontario Government. I got my rent cheques from the government like clockwork, even when ie was in jail for 6 months at a time. however, every 3-4 months the fire Marshall would come by and order the apatment emptied becuase it was a fire hazard. The government would pay for this, including labour and dump charges. However, the insurancew company someohow heard about it and tripled my insurance until he moved out. I went to court about it, only to have the government itself fight me. It took two and a half years of constant cout appearances to get him out. He direvctly caused me several empty apartments becuase of the odour and the cigarette smoke in the corridors.
2nd guy. Moved in at Christmcas, with a sweet looking wife and duaghter and a terrible tale of woe. They paid one months rent and promised me the last months' the next day. 10 months later and after 4 trips to the rent tribunal that was all he paid. When the sherrif came to evict him both he and his wife screamed invectives at me about being a dirty Jew, and how rich jews play upon poor people, and more of the same. When we got into the apartment, the brand new carpet I'd installed 10 months earlier was ripped, torn, and covered with, well, guess what!. One door was off it's hinges and the bathroom had to be re-drywalled. So I lost 10 months rent and 3 grand worth of repairs becuase the Landlord/tenant act is so completely skewed towards the tenenat.
We had a dozen more like this over the years. My wife met one woman we'd evicted, 2 years later at another tribunal, where another landlord was trying to bet her evicted from his building. It was remanded for 2 months because of a minor glitch in paperwork.

I could go on and on. I sold the apartment after6 1/2 years, for what I paid for originally. I lost at least $150,000.00 During that time, I replaced 12 fridges, 16 full carpet jobs, 8 toilets, and 7 stoves. All brand new, all from tenant's deliberate damage.
And lest you think it was a slum building, it was situated in a medium income single family hoime development and was a decent building. I just couldn't hang on any more.
Damn. Sorry to vent. I haven't though about this in a few years, but boy, does it get my back up when I hear of this crap.

Yup, commercial is the only way to go........they don't pay........90 days and padlock on the door.

Even when you get an eviction, you can't have them removed during winter months. Happens all the time.

Had an unfortunate incident renting our basement apartment some years back, never again. Tribunal n it's rules are geared 110% towards scammers taking you for a ride.

Wasnt there anything landlord could do? I presume teenant didnt sign anything so he was using that property illegally. Call TPS or Toronto locksmith of some sort to help him open a door. And why he hesitated that much?

Tenants are in the drivers seat. Unlawfully changing locks or tossing him or her out would end badly for the landlord.

Oh! I didn`t saw a sentence that they had already assigned a deal. My bad! In other case calling someone not included in the conversation and relations between would be good. Lock smith Toronto (http://locksmithtoronto365.com/) or police. In the other hand, i dont know what i would have done if i had the same problem
