    ^He claims he had two, not sure why he wasn't tested roadside. That's why I said hell do 4 years, if anything.

    So if I say he should have been charged with murder will everyone jump on me again like the last time there was a drunk driving death discussed on this board?

    If everyone does what they are suppose to, there is already means to get the right outcome. Seems very odd there was no mention of a breathalyzer but instead the judge estimates how impaired he was.

    It's tough to say given the limited evidence and lack of breathalyzer, kinda dumb to state "I'm sure he would have blown nearly twice the legal limit"......why not test him? At least a roadside sobriety would do....now they have nothing on him, really. I agree with you to a point though, for all we know he hated that passenger and intended for them to die, not likely I know, but it would be the easiest way to get away with murder.
