I guess the question would be. Was she talking shit because of their race or was she talking shit because the couldn't do their job properly due to lack of ability to speak English.
On the hiring side. Yes descimination to not hire due to race. But if the person can't do the job because they can't speak the language then not hireing them would not qualify as descrimination.
